When booking a session, the client(s) agree upon these terms and conditions of service.
USAGE RIGHTS AND OWNERSHIP
The client(s) acknowledges that the photographer is the sole owner of all copyrights of the image(s) and the author of the image(s).
PHOTOGRAPHIC INTEGRITY AND ALTERATIONS
The client(s) will not make or allow any alterations, including, but not limited to, filters, cropping, or adaptations, to the image(s) without the prior written permission of the photographer.
Image(s) taken during the course of a session will be at the discretion of the photographer. However, efforts will be made to comply with the clients special requests and wishes.
The client(s) is obtaining image(s) for personal use only, and shall not sell images.
DISPLAY
The client(s) allows the photographer to display any image(s) covered by this agreement and to generally promote the business in advertising, websites, sample albums, social media, etc.
PAYMENT
A 50% non-refundable deposit, up to a maximum of $500, is required at the time of booking. Payment in full will be required at the time of the photography session. Further deposits may be required at the discretion of the photographer for custom sessions.
CANCELLATION POLICY
If the client(s) need to cancel a photography session, the non-refundable deposit will be forfeited.
If the photographer cancels the session due to any unforeseeable situation, the photography session deposit will be returned, and the session will be rescheduled to a better date.
SESSION TERMS
Sessions will be conducted at a location agreed upon by the photographer and client(s). The photographer will not trespass or use any property/locations that is not permitted. If the client(s) wishes to shoot on private property, it is the client(s) responsibility to get permission from the owner of the property. The client(s) agrees to enter into the session at their own risk.
DIGITAL FILES
The client(s) is responsible to properly store and archive the image(s) upon delivery of the finished product. The photographer cannot guarantee the availability of any image(s) on the website beyond the first two weeks of delivery of the photography session. Any further requests for the photographer to reproduce image(s) that were already delivered will result in a $50 processing fee.
Editing of image(s) is done at the photographer’s discretion. The photographer reserves the right to refuse any additional editing requests. If the client(s) choose to request additional editing or altering of image(s), this is done at a separate fee starting at $25 per image.
